Katy Perry runs hot and then cold

American pop singer Katy Perry (famous for tracks that include ‘Hot n Cold’ and ‘I kissed a girl’), recently objected to an application by Australian fashion designer, Katie Perry, to register the name ‘Katie Perry’ as a trade mark in Australia in class 25 (clothes).

Katie Perry’s trade mark application was filed with IP Australia on 29 September 2008 and Katy Perry filed a notice of opposition to that application on 8 May 2009.

After some legal wrangling (which included Katy Perry’s lawyers demanding that Katie Perry withdraw her trade mark application, withdraw the sale of ‘Katie Perry’ branded clothes and withdraw ‘Katie Perry’ branded advertisements and websites), the dispute was apparently resolved. Katy Perry’s notice of opposition was withdrawn on 16 July 2009. In the result, the words ‘Katie Perry’ are now a registered trade mark in Australia in class 25 (clothes).

Katy Perry has now filed her own application to register the words ‘Katy Perry’ as a trade mark in Australia in classes 9, 25 and 41. That application was filed on 26 June 2009.

Time will tell whether anyone (including anyone named Katy Perry or similar), decides to oppose Katy Perry’s application.
