A New Victorian Costs Court

On 31 December 2009, a new specialist Costs Court commenced its operations within the Trial Division of the Victorian Supreme Court.
The Costs Court has jurisdiction to hear and determine the assessment, settling, taxation and review of costs in all proceedings in the Victorian Supreme Court.
The Costs Court also has jurisdiction to hear and determine the assessment, settling, taxation and review of costs in the Victorian County Court, in the Victorian Magistrates’ Court and in the Victorian Civil and Administrative Tribunal (“VCAT”) in any of the following circumstances:
1. Where pursuant to any Act or Rules costs are to be assessed, settled, taxed or reviewed by the Costs Court.
2. Where pursuant to any order of the Victorian County Court, the Victorian Magistrates’ Court or VCAT costs are to be assessed, settled, taxed or reviewed by the Costs Court.
3. Where there is an entitlement to costs pursuant to any Act, Rules or order of the Victorian County Court, the Victorian Magistrates’ Court or VCAT and the amount of those costs has not been fixed by the Victorian County Court, by the Victorian Magistrates’ Court or by VCAT. In those circumstances, the orders of the Costs Court are taken to be orders of the Victorian County Court, the Victorian Magistrates’ Court or VCAT.
The Costs Court must exercise its jurisdiction expeditiously and with as little formality and technicality as possible. |
